Cardholder Agreement IMPORTANT – PLEASE READ CAREFULLY
Terms and Conditions/Definitions for the SABREBUCKS Discover Network Prepaid
Card - This document constitutes the agreement (“Agreement”) outlining the
terms and conditions under which a membership benefits card has been issued to
you by Hockey Western New York, LLC (Buffalo Sabres),
Please read this Agreement carefully and keep it for future reference.
By accepting and using the Card, you agree to be bound by the terms and
conditions contained in this Agreement. “Card”means the
Sabrebucks card issued to you by the Buffalo Sabres
through First California Bank. First California Bank is an FDIC insured member
institution. “Card Account” means the records we maintain to account for the
value of claims associated with the Card. “You” and “your” mean the person or
persons who have received the Card and are authorized to use the Card as
provided for in this Agreement. “We,” “us,” and “our” mean First California Bank
and the Buffalo Sabres, our successors, affiliates
or assignees. You acknowledge and agree that the value available in the Card
Account is limited to the funds that you have loaded into the Card Account or
have been loaded into the Card Account on your behalf. You agree to sign the
back of the Card immediately upon receipt. The expiration date of the Card (not
the program) is identified on the front of your Card.
About the SabrebucksCard
- The Card is a prepaid card that can be used to purchase goods or services at
participating merchants within the First Niagara Center and/or at authorized
sponsors of the Sabrebucks program.Please visit the

participating merchants and more information.The Card may not be used to make
purchases from other locations unless so authorized, or to obtain cash from
automated teller machines (ATM) or for any other type of purchase or cash
advance. Season ticketholders and mini pack holders receive the Card from the
Buffalo Sabres already preloaded (preloaded amount
equal to a percentage of the value of tickets purchased).The Cards can also be
purchased by other individuals at First Niagara Center .You can reload a dollar
value on the Card at First Niagara Center using cash, an approved credit card or
debit card. You may also reload a dollar value on the Card by going on-line to
www.sabres.com (Sabrebucks

using an approved credit card. If the amount of value on your card does not
cover the total purchase amount, you will need to pay the remainder of the
purchase with a valid form of payment. If the value of your Card is more than
the total order amount, the balance amount will be stored on the Card account
for future use. Each time you use the Card, you authorize us to reduce the value
available on your Card Account by the amount of the transaction and any
applicable fees. The Card is not connected in any way to any other account. The
Card is not a credit or debit card. You will not receive any interest, dividends
or other earnings on your funds in the Card Account. The Card will remain the
property of the Buffalo Sabres and must be
surrendered upon demand. The Card is nontransferable and it may be canceled,
repossessed, or revoked at any time without prior notice subject to applicable
law. We reserve the right not to accept, load, reload or re-issue any Card or
otherwise limit the use of a Card if we reasonably believe that the use is
unauthorized, fraudulent or otherwise unlawful. The Card is not redeemable for
cash except as required by law.
As a Sabrebuckscardholder you may have access to
various special offers for merchandise at the Team Store, concessions, tickets,
and other unique specialty programs. These offers are subject to availability
and may change without notice.
Obtaining Your Card
-The USA PATRIOT Act is a federal law that requires all financial institutions
to obtain, verify, and record information that identifies each person who opens
a Card Account. What this means for you: When you open a Card Account, the
Buffalo Sabres and DCR Strategies, Inc will ask for
your name, address, and other information that will allow us to identify you.
They may also ask to see your driver’s license or other identifying documents
including photo identification.
Confidentiality–
This program is being implemented in conjunction with DCR Strategies, Inc.
(DCR).DCR is an MSP (Member Service Provider) of First California Bank (Issuer
of Discover).DCR acts as program manager for this Incentive Card program and
will be engaged with cardholder for customer service and support.In addition to
the details set forth in the privacy statement(s) (see

www.sabres.com)
DCR and Buffalo Sabresmay disclose information to
third parties about your Card or the transaction you make: 1) Where it is
necessary for completing transactions; 2) In order to verify the existence and
status of your Card for a third party, such as a merchant; 3) in order to comply
with government agency, court order, or other legal reporting requirements; 4)
To our employees, auditors, affiliate, service providers, or attorneys as
needed, or 5) as otherwise agreed in writing.
Authorized Users -
You are responsible for all authorized transactions initiated and fees incurred
by use of your Card. If you permit another person to have access to your Card or
Card number, we will treat this as if you have authorized such use and you will
be liable for all transactions and fees incurred by those persons. You are
wholly responsible for the use of each Card according to the terms and
conditions of this Agreement.
Returns and Refunds-
If you are entitled to a refund for any reason for goods or services obtained
with your Card, you agree to accept credits to your Card Account for such
refunds.
Receipts
-You should always receive a receipt at the time you make a transaction using
your Card.You agree to retain your receipts to verify your transactions.You may
check the balance of your card and transaction history through the e-wallet
function at www.sabres.com.
Fee Schedule–
All fee amounts will be withdrawn from your Card Account. There will be a $.20
fee per transaction.For example, if you have $10.00 on your card, you may spend
up to $9.80..
Additional/Optional Service Fees Shouldyou
need to split your card account with another person, or replace your Card, there
will be a $2.00 charge per card; ATM Access Decline Fee: $1.00 (This card does
NOT have ATM access. If a cardholder tries to access cash via an ATM this
transaction will be declined at the ATM terminal, a network transaction decline
fee will be assessed to the card account balance each time); A POS declined
transaction fee will be $0.20.; Card to card transfer fee is $1.00; Account
Balance Website Access: $0.00; 24/7 Customer Service Support and lost/stolen
reporting: $0.00; Chargeback Fee: $10.00 (Fee assessed by network for disputed
transactions launched by cardholder against merchant)
Funds Balance: Season Ticket Holder–
The amount of funds shown on record at First Niagara Center shall be deemed the
balance on the Card, unless one can prove, to the satisfaction of the Buffalo
Sabres, in their sole discretion, that there should
be a different balance.You should monitor your transactions and account balances
closely.
a)
Season Ticketholder & Mini Pack Sabrebuck Cards - Season ticketholders and mini pack holders can
utilize their Cards from season to season provided the cardholder remains a
season ticketholder or mini pack holder. In the event that you have decided NOT
to renew your season tickets or mini pack, you will have up to six (6)months from notice to use up your
balance of funds. Following the six (6) months, Buffalo
Sabres reserve the right, but not the obligation to
apply an account maintenance/membership fee
against the remaining funds until
the account is at zero balance. In the event the existing balance is less than
the maintenance/membership fee, only the available funds will be applied against
the maintenance/membership fee.
b)
Single Purchase SabrebuckCards – A Card purchaser
can utilize their Card from season to season. However, an inactive card defined
as a Card which has no activity for (twelve) 12
consecutive months will result in a maintenance account fee of $2.00 per month
being assessed commencing each month thereafter.
YourLiability
for Unauthorized Transfers and Lost Cards-
Treat your card like cash. Contact the Buffalo Sabresor
DCR Strategies at once if you believe your Card has been lost, stolen or
compromised in any way. Telephoning is the best way to minimize your possible
losses. If you believe your Card has been lost or stolen, or that someone has
transferred or may transfer money from your Card Account without your
permission, call the Buffalo Sabres at
1.800.Go.SABRES or DCR Strategies at 1-800-624-6171.We will be able to suspend
your card account balance and offer an array of replacement card services that
best fit your requirements.Your liability for all unauthorized transactions
ceases upon your notifying a person at our customer service center that your
card has been lost, stolen or compromised.
All funds that have been spent up to the reporting of the card being lost,
stolen or compromised will be considered authorized transactions and will not be
reimbursed back to you.
Amendment–The
Buffalo Sabres may amend the terms and conditions of
this Agreement at any time by posting new terms at the
Sabrebucks page, located on the Buffalo Sabreswebsite
at
www.sabres.comAs
permitted by applicable law, any amendment may become effective at the time we
post the amended agreement on our website or as otherwise stated in our notice
to you.
Assignment
–The Buffalo Sabres may assign all or part of this
Agreement without notice to you.The Buffalo
Sabresare then
released from all liability.The assignee shall have the same rights and
obligations as the assignor and shall agree in writing to be bound by the terms
and conditions of this agreement.
Entire Agreement–
This Agreement is the complete and exclusive statement of the terms and
conditions and supersedes and merges all prior proposals and all other
agreements. In the event that any provision of this Agreement shall be
determined to be illegal or unenforceable, that provision will be eliminated to
the minimum extent necessary so that this Agreement shall otherwise remain in
full force and effect and enforceable..
Limits of Liability
–This Agreement shall be governed and construed in accordance with the laws of
New York.Subject to the applicable law, the Buffalo
Sabres , or its
affiliates, make no representations or warranties of any kind with respect to
the Card, including, but not limited to implied warranties of merchantability or
fitness for a particular use. In the event the Buffalo
Sabres or its affiliates are found liable to you, you shall only be
entitled to recover actual and direct damages and such damages shall not exceed
the last balance held on your Card prior to the time in which damages are
sought. Buffalo Sabres and it
affiliates shall have no liability for any incidental, indirect, consequential,
special or punitive damages. In no event shall BuffaloSabres
or its affiliates have any liability for unauthorized access to, or alteration,
theft or destruction of the Card through accident, misuse, or fraudulent means
or devices by you or any third party, or as result of any delay or mistake
resulting from any circumstances beyond our control.
